Terms of Service

1. Purpose

These Terms of Service ("Terms") govern access to and use of the DevPrism platform ("the Service"), published by DevPrism SAS. The Service is an Engineering Intelligence platform that collects, analyzes and correlates software engineering metrics (DORA, SPACE, AI Impact) from third-party integrations (GitHub, Azure DevOps, GitLab, Jira, SonarQube, etc.).

2. Access to the Service

Access to the Service requires creating an account via the signup form or via SSO (Microsoft Entra ID). Users agree to provide accurate information and maintain the confidentiality of their credentials. Each organization has an isolated space (multi-tenant). The organization administrator is responsible for managing their members' access.

3. User Obligations

Users agree to: (a) use the Service for its intended purpose (software engineering intelligence); (b) not attempt to access other organizations' data; (c) not use the Service for abusive individual developer surveillance; (d) comply with the terms of use of connected third-party APIs (GitHub, Azure DevOps, etc.); (e) not circumvent security mechanisms, quotas, or Service limits.

4. Intellectual Property

The Service, its source code, algorithms, AI models, and documentation are the exclusive property of DevPrism SAS. Users retain all rights to their source data (code, commits, tickets). DevPrism never accesses source code content — only metadata (PR titles, metrics, statistics) is collected and analyzed.

5. Data and Security

Data is hosted in the European Union (Azure France Central). Encryption is applied at rest (AES-256-GCM) and in transit (TLS 1.3). Integration tokens are encrypted in the database. Multi-tenant isolation is guaranteed at the application level. No client source code is stored or transmitted to third-party AI models.

6. Liability

DevPrism provides the Service "as is". DevPrism does not guarantee uninterrupted availability and shall not be held liable for indirect damages. DevPrism's liability is limited to amounts paid by the user in the preceding 12 months. DevPrism is not responsible for actions taken by AI agents in "Auto-Act" mode — users are responsible for configuring their autonomy policies.

7. Termination

Users may cancel their subscription at any time from account settings. Data is retained for 30 days after termination to allow reactivation, then permanently deleted (GDPR right to erasure). DevPrism reserves the right to suspend an account for Terms violations, after 7 days prior notice except in emergencies.

8. Governing Law

These Terms are governed by French law. In case of dispute, parties agree to seek an amicable resolution. Failing this, the courts of Paris shall have jurisdiction. These Terms are available in several languages; in case of discrepancy of interpretation between versions, the English version prevails, except for clients established in France, for whom the French version prevails.
